Tall Grass, Weeds, and Tree Trimming

Quick answer: This is the Village's property upkeep rule for grass, weeds, and trees. It sets a maximum grass height, requires you to clear noxious weeds, and sets how high trees must be trimmed over sidewalks and streets. It also explains the notice you get before enforcement.

What you need to know

  • Grass and weeds: Keep your land clear of tall or noxious weeds and grass. Grass and weeds must stay under 7 inches tall.
  • Tree trimming: Trees must be trimmed to a clear height of 10 feet over sidewalks and 12 feet over the street. Branches near street lights must be trimmed so they don’t block the light.
  • Notice and deadlines: If you’re in violation, you get written notice. Weeds and grass must be cut within 5 days of the notice. Trees and shrubs must be trimmed within 15 days.
  • Out-of-town owners: If the property owner lives elsewhere, notice is still served to their known address.

If you don’t comply

  • Every day you stay in violation is a separate minor misdemeanor.
  • If you don’t cut it after the notice, the Village can cut it for you and charge you $100 per hour (minimum $100), including labor, equipment, and mailing costs.
  • If you don’t pay within 30 days, the cost gets added to your property tax bill through the Miami County Auditor.
  • If you violate again the same year, the Village can act without sending a new notice first.
